Governor Mark Gordon issued a new Executive Order (Executive Order #6) on April 3, 2020. This new Executive Order was issued as new guidelines for alcohol sales. On March 30, 2020 Governor Gordon issued an earlier Executive Order allowing restaurant and bar & grill liquor license holders to temporarily sell a limited amount of beer and wine for off-premise consumption with curbside food purchases. The order is currently in effect and is dated through April 17, 2020.
The order is a means to help supplement the incomes of restaurant and bar & grill liquor license holders that are unable to open their dining rooms with the onset of the COVID-19 pandemic. “This is intended to help these businesses that are really taking a hard knock at this particular time,” Gordon said. “This Executive Order provides an opportunity for an additional source of revenue for these businesses.”
The following conditions apply for the sale of beer and wine for off-premise consumption:
o Alcohol sale must occur within the licensed restaurant or bar & grill building via electronic payment
o Alcohol prices must be at regular menu prices in effect before March 18
o Food and alcohol sales must be on the same receipt
o Alcohol sales cannot be more than 49% of the total pre-tax order (THIS HAS BEEN REMOVED IN EXECUTIVE ORDER #6)
o Alcohol must be in its original, sealed container
o Alcohol sales are limited to 48 oz. of beer and 750 ml. of wine (THIS HAS BEEN UPDATED TO 72 OZ OF BEER AND 1500 ML OF WINE IN EXECUTIVE ORDER #6)
o Applies to take-out or curbside pickup directly at the licensed business
o Age restrictions and all other requirements for liquor sales apply
The order does not legalize alcohol delivery, and extends only to curbside pickup or takeout orders. All participating bars and restaurants must notify local law enforcement of their intent to sell and provide a menu to ensure they are within compliance.
